Data Acquisition & Testing Services Limited STANDARD TERMS AND CONDITIONS OF HIRE AND LOAN Version 2.00 25/02/2013

1. The customer takes full responsibility for the safe custody of equipment from the time it is collected from, or delivered by, Data Acquisition & Testing Services Limited to the time it is returned to, or collected by, Data Acquisition & Testing Services Limited. The Title to the equipment remains with Data Acquisition & Testing Services Limited at all times.

2. The Customer accepts responsibility for: a. Insuring the equipment against all risks, including those arising from transit, storage and exhibition, to its full value for the full rental period. b. Insuring against Third Party and Public Liability risk while the equipment is in its care and being used by it.

3. The customer will provide suitable transport and packing material for collection and return of the equipment unless Data Acquisition & Testing Services Limited undertakes collection and return. Data Acquisition & Testing Services Limited reserves the right to refuse an otherwise agreed hire if the customer, when collecting the equipment, arrives with transport and/or packing considered unsuitable by Data Acquisition & Testing Services Limited, although Data Acquisition & Testing Services Limited takes no responsibility for any loss occurring as a result of its approval of or failure to disapprove transport and/or packing, which are deemed unsuitable.

4. Data Acquisition & Testing Services Limited reserves the right to charge for Service Engineer’s travel and on-site costs at the current rate when installing or dismantling the equipment, when such installation or dismantling is requested by the customer or is deemed necessary by Data Acquisition & Testing Services Limited.

5. The customer agrees to maintain the equipment in good condition and to indemnify Data Acquisition & Testing Services Limited against all repairs, replacement and other costs if equipment is damaged during the rental period.

6. If, in the event of equipment failure during the rental period, the customer required on-site repair, Data Acquisition & Testing Services Limited reserves the right to charge for travel and labour costs. If, in such an event, (which excludes any such damage as is referred to in paragraph 5), the customer returns the equipment to Data Acquisition & Testing Services Limited the repair will not be charged for.

7. The customer agrees not to tamper in any way with the equipment other than by way of adjustment of external controls and further agrees to comply strictly with all instructions and operating manuals relating to the equipment.

8. Unless the customer notifies Data Acquisition & Testing Services Limited of any defect in the equipment within 3 days after collection, the equipment will be deemed to have been in good working order and condition at the time of its collection.

9. It is expressly forbidden that Equipment Loaned or Hired by Data Acquisition & Testing Services Limited is re-hired to a third party in any manner without the express written permission from a Director of Data Acquisition & Testing Services Limited
